Qu’est ce que l’indice réparabilité ?
Il s’agit d’une note sur 10 calculée par le metteur en marché d’un produit et affichée par le distributeur de ce produit. Les notes sont assorties d’un code couleur allant du rouge au vert. L’obligation d’affichage s’applique tant en magasin qu’en cas de vente en ligne. Cette nouvelle obligation d’information entre en vigueur au 1er janvier 2021, et les sanctions associées le 1er janvier 2022.

Quel est son objectif ?
Beaucoup de mesures de la loi Anti-Gaspillage pour une Economie Circulaire visent à donner les moyens au consommateur de faire des choix éclairés quant aux produits qu’il achète. L’indice de réparabilité vise ainsi à aider le consommateur à comprendre le niveau de réparabilité de son produit.
L’objectif du gouvernement est non seulement d’orienter le marché vers des produits plus réparables et durables, à l’image de l’étiquette énergie, mais aussi d’inciter les fabricants à revoir leurs pratiques commerciales et la conception de leurs produits.
Dans la perspective de la future extension de l’indice à d’autres produits et de son évolution en un futur indice durabilité en 2024 comme prévu par la loi, l’AFNUM a appelé à la mise en place d’un comité de suivi de l’indice, pour évaluer et observer les pratiques et les éventuelles difficultés et questions, travailler avec les pouvoirs publics sur la communication autour de cet indice, se tenir informés des avancées européennes et disposer d’un retour d’expérience.

D’autres mesures de la loi économie circulaire traitent de la réparation : la livraison sous 15 jours ouvrés des pièces détachées, au lieu de 2 mois auparavant, la mise à disposition obligatoire de certaines pièces pour certains produits, l’utilisation de pièces détachées issues de l’économie circulaire, la possibilité du recours à la technologie 3D pour les pièces qui ne seront plus disponibles, et bientôt la mise en place d’un fond réparation pour réduire le coût de la réparation pour le consommateur lorsqu’il se rend chez un réparateur labellisé.

Comment l’indice a-t-il été élaboré ?
Pendant plus de deux ans, des groupes de travail rassemblant l’ensemble des parties prenantes (pouvoirs publics, fabricants, réparateurs, distributeurs, consommateurs, ONG…) ont travaillé à la co-construction des grilles d’élaboration de cet indice.
Très impliquée depuis l’origine des travaux en juin 2018, l’AFNUM a piloté le groupe smartphone et s’est investie activement au sein des groupes téléviseurs et ordinateurs portables.
Comment l’indice est-il constitué ?
L’indice valorise les bonnes pratiques sur 5 catégories de critères relatifs :
- aux documents et notices concernant l’appareil (notice détaillée, schéma de démontage, vue éclatée des câblages…)
- au démontage de l’appareil (pièces amovibles ou non, nombre d’étapes, outils nécessaires à la réparation…)
- aux pièces détachées (disponibilité et délais de livraison)
- aux prix de ces pièces détachées
- aux spécificités des produits concernés (exemples : mises à jour logicielles pour les téléphones et ordinateurs, assistance à distance…)

Quelles sont les sanctions prévues ?
La Direction Générale de la Concurrence, de la Consommation et de la Répression des Fraudes est l’organe chargé de vérifier la véracité des déclarations et de contrôler la bonne application de l’indice. Une amende pouvant aller jusqu’à 15 000 euros par produit est prévue en cas d’un affichage manquant ou mensonger de l’indice, toutefois les sanctions ne seront applicables qu’à partir du 1er janvier 2022, 2021 étant ainsi une année pilote pour la bonne mise en place de l’indice.
