Le Règlement sur l’Intelligence Artificielle introduit une approche par le risque des différentes IA : interdite, à hauts risques ou interagissant avec des personnes. Le 13 mai 2022, la présidence française de l’union européenne a publié sa dernière proposition de compromis concernant ce règlement, en incluant au sein du champ d’application les systèmes généraux d’intelligences artificielles.

Ce changement a pour conséquence de fragiliser l’approche par le risque : en effet, en imposant aux fournisseurs de systèmes généraux de réaliser les obligations de conformité propres aux systèmes à hauts risques, le Conseil de l’Union fragilise le développement d’une industrie européenne de l’IA et soumet les développeurs à des obligations irréalisables.
L’AFNUM ainsi que 10 organisations internationales européennes appellent donc le Conseil et le Parlement à revenir sur leur position qui entravera l’innovation dans toute l’UE. Des recommandations sont d’ailleurs proposées pour mieux équilibrer les responsabilités entre les développeurs et les déployeurs de l’Intelligence Artificielle, et ainsi soutenir la transformation numérique de l’Europe.
